but on a more serious note suaknee get w.e. info you can, go see a dr. asap that way they can get proof of the injuries before they fade away. Make sure you can take with you any info that you can such as the info that tj stated in the beginning of the thread. The more you know the less they can pull on you. Also make sure your lawyer has the same info, he is very good with the law (or should be) and should be able to prove a point. You dont have a previous record (I am assuming) which should also hold up good in court and remember the truth helps so if the judge wants to know what you were doing there just tell them the truth. I would rather have a measly driving offense than a criminal one anytime.

Thanks guys for your comments. Its a serious time, so its really good to know, or feel every ounce of support. Well, my court date is Monday March 20th, 8:00am. I'm nervous, but I know this will be a good experience, ironicly. Ive hired a lawyer which I hope will be by my side every step of the way. I'm pleading not guilty, and we are going to try to get the charges dropped or just down to a misdemenor. I know I'm innocent from fighting back with and without violence. I have no doubt in my heart, and I hope the truth comes out about these cops. Well thats it, I can go on, but
I won't. Thank you for reading my story so far. Again, my court date is Monday 8:00am. If anybody would like to make it and be there. Let me know. It would mean the world.

What time of night was this, and what exactly did you tell the cop your reason was for wandering sneaking around?

I wish you the best of luck, but honestly, you will spend more money and time then its worth. I am not syaing dont fight it, because you cannot let them overstep their boundaries, but it will cost you alot of money for yours lawyers, and such...if you want a good lawyer who will win that is.

You can only hope that this asshole has prior complaints, and that you are his first class ticket to civilian life.

this is what really happened, i went with him monday, and things are moving smoothely, he has another court date in may. so we'll see how it goes

Heres the update guys.

After gettin the deposition of the cops, they aren't backing down from their story.
I was eligible for a PTI ( Pre-Trial Intervention ) program and I could just join
some classes and the charges would be dropped. But since they feel it is a
violence crime, they changed their mind and thats out of the option. Today
we asked the judge and she said she wish she can allow me in there but thats
something she can't change.

So now I have the choice of paying more money to go to trial and put my fate into
a jury. IF I win, all is good, but if I lose, I get up to 5 years, and convicted felon
on my record. Even though I still am innocent. =(

Or

I can take a deal from the State Attorney, which is probation for 2 years
and get early termination after 1 year, and sealed records so its like it
never happened.

Let me hear what you think.

Sealed records = immediate or after 5yrs? I know when I was convicted of a felony, and I went that route, the lawyer explained to me that it would be a sealed record after 5yrs if I didn't get arrested for anything within those 5yrs. Not sure, if it's the same deal with you, but just double check it. Cuz it sucks trying to get a job with crap on your record. :(
 
Damn that sucks man... I have no legal experience so I am not much help. I would like to tell you to go through with the risk and make them pay for what they have done.... but I know its a big risk.
 
Damn Dude. if the sealed record thing is immediate take it and run. if it is after 5 years I hope you have a good job because when an emplyer dose a background check and the word "felon" shows up they get hesitant with hiring you.
 
this sucks big time.....There isnt really much that can be done......What I have learned from studying law is one thing, without proof you have nothing.....It's like that saying you cant get convicted for murder twice if you killed the person twice......It's a saying they have in law classes....well that is one reason why you should never be alone and always have a camera with you....becuase if you did have a camera before hand and someone else there, the most you would have been charged for is loitering and destroying private property and have those bastards on leave of absence with pay.......Unitl they investigate even more into it and check out the cameras on the parking lot that this occurred at, from the warehouse..Since you would have proof that the only thing you was doing was making donuts and nothing else.......than a chain starts building up after that which a good lawyer can make the case even harder for the davie police to defend their case......Main objective always be with someone and have a camera recording you drift illegally just in case this happens again to anyone else and if you dont have a camera, go buy one you can get one as cheap as 150 bux.......

Yeah I definitely don't go to spots anymore and by myself either.
