pay the ticket. not even worth the pita to have the people check it. you still would have to pay some money anyway after they ok'd your car.
 
Go to court and risk paying 100s in court fees or just suck it up and pay the fix-it-ticket fee and be done with it. Why make a big deal out of something so small. I swear people are always trying to beat the law and end up fucking shit up worse.

You cannot argue the officer's judgment in court. However, you should be able to make a video of your exhaust, show that it emits no black smoke, and take it to a police station. Or go to a muffler shop and have them give you a receipt of it getting fixed.

What you may also be able to do is challenge the officer's ability to quantify what is an "excessive" amount of smoke. Is it excessive when smoke is constantly pouring out of the car, or if a small puff comes out?

Either way, a video and/or receipt detail repair should be sufficient to get it dismissed. You may be required to pay a dismissal fee, though.

yeah thats what i was thinking bcuz the diesel law is 5 sec. of black smoke emitted between shifting, now i know for a FACT that more than half of diesel trucks around here emit atleast 10 sec. of smoke.


Yes i know the rules on this one i come from driving diesel trucks.
They cannot stop u simply because u have resedue or a poof of smoke the smoke has to be in such an excess that it blocks the sight of following or on coming traffic.
I can find u the statue if needed my mothers a parreligel and ive been stopped for this before in my truck, chances are the cop gave u the ticket thinking ud just pay it an move on because most ppl dont have the time to take off work an fight it. id take it to court for sure lmk if u need any help

and im deff fighting this one bcuz ocean ridge cops have no life and thats how they make their "quota" and I'm tired of being pulled over becuz i have and exhaust and my car sits low.
 
$90 is the faulty equipment price whether you win the case or not they are still going to make you pay it lol been there done that..it sucks but thats why America is the best country to live in.

316.610 Safety of vehicle; inspection.--It is a violation of this chapter for any person to drive or move, or for the owner or his or her duly authorized representative to cause or knowingly permit to be driven or moved, on any highway any vehicle or combination of vehicles which is in such unsafe condition as to endanger any person or property, or which does not contain those parts or is not at all times equipped with such lamps and other equipment in proper condition and adjustment as required in this chapter, or which is equipped in any manner in violation of this chapter, or for any person to do any act forbidden or fail to perform any act required under this chapter.

(1) Any police officer may at any time, upon reasonable cause to believe that a vehicle is unsafe or not equipped as required by law, or that its equipment is not in proper adjustment or repair, require the driver of the vehicle to stop and submit the vehicle to an inspection and such test with reference thereto as may be appropriate.

(2) In the event the vehicle is found to be in unsafe condition or any required part or equipment is not present or is not in proper repair and adjustment, and the continued operation would probably present an unduly hazardous operating condition, the officer may require the vehicle to be immediately repaired or removed from use. However, if continuous operation would not present unduly hazardous operating conditions, that is, in the case of equipment defects such as tailpipes, mufflers, windshield wipers, marginally worn tires, the officer shall give written notice to require proper repair and adjustment of same within 48 hours, excluding Sunday.

take it to court, say your car burns oil, cop wont show, u pay some stupid court costs.
 
Saying you shouldn't even fight it is stupid.. might as well be a slave and have no rights.

Saying you should fight it when you indeed broke the law regardless of what the officer wrote on the ticket is stupid. Any form of modification to the OEM exhaust is indeed breaking the law. Hence why I say just pay the fix-it-ticket fee instead of risking court costs and other retarded shit.
