Guy bought car off me 5 months ago and didnt pick it up STILL! What to do?

if you have the title the car is still legally yours.. does he have a bill of sale/ reciept? if he doesnt answer calls or emails then you have no choice but to re-sell the car, take what you think is owed to you for storage fees and paypal fees and personal fees. i.e the stress brought to you by the buyer. then refund him whats left and re-sell the car. its that simple. and in my eyes its a win win.

Im just worried if I do something like that (sell car etc) He will take me to court or something and I dont want to deal with that. Im not sure.

Well what should I do when he eventually says "alright I have money to ship it now" and I say sorry buddy its been sold. I think he could take me to court, no?
 
well you cant just go and sell it tom. email or call him, tell him he has X amount of time to get the car removed from your property or he will lose his money and the car will be up for sale again. then offer him the car again for half off lol..
 
i havent heard form my friend yet, but heres what i would do...

write up a letter telling him that if the car is not picked up, or arrangments have not been made within 15/30/60 days (whatever you want), you will re-sell the car, and he will loose his investment. Get rhe letter notarized, and email and mail him a copy, and keep a copy for yourself of course. This way he has notice that he will be loosing his investment if he doesn't act soon.

PS: when amiling, send it certified mail, and return receipt requested to make sure he gets it.

just my .02...but maybe talk with a legal pro about it first...

Lmao. How does a two weeks sound for the guy to pick it up??? If I tell him 2 weeks and he doesnt pick it up Im going to resell. Can you tell me any legal actions he can take though?

I think I'll tell him 15days. But why would I get the letter notarized, I dont understand why a notary needs to look at it. Thanks for all your help so far guys! :bigthumbu

that way you have proof that a state certified official looked at it and approved that its your signature.
 
What if he doesnt reply and give me a mailing address so I can send it to him? Im going to mail this to him so far let me know what you guys think:

put in something about either picking it up, or arrangments being made. He might be in a tough spot getting it shipped within two weeks.

also, add in examples of how you have tried to contact him, along with any original verbal agreements you made about picking up the car.

remember, this is meant to be more of a legal document to protect your ass...so document everything as clearly as you can!

We talked when you bought the car back in January and I allowed you to keep it here for two months, its been five now and you still havent gotten it. Ive tried numerous times to contact you about payment for storage and towing to my house and you didnt pay so I was forced to take payment by removing parts from the car. You have until July 12th to pick up the car, I will be here any day you wish to pick it up just let me know but you have 15 days total. Please give me your address so that I can send my Notarized documentation about this matter.

better, but few things...

1- dont put that you've talked with a lawyer until you actually have.

2- see if there is a to get his address through paypal. if not, make sure you have some sort of confirmation that he read it! send a copy to paypal as well for safe measure.

3- if you have his number, call him and leave a messege stating it as well.
 
Alright thanks. I just sent the email to him, we'll see what happens. I dont have his number and I cant find his addy on Paypal.
