anyone dealt with insurance companys? total loss?

so quick run down, car 89 s13 coupe (lots of mods), some bitch hit me driver side, between door and fender, I see no structural damage, so easy repair..

My insurance (esurance) estimates the damage at $1700 (-1000 deductible, fml), her insurance, united (POS) estimates the damage at 1500. since shes at fault ill let them pay..

They are declaring the car a total loss, BUT, I dont have to turn in the title/car or sign any paper work related to total loss according to their adjuster... for them to cut me a check for the repair all I have to sign is their wavier freeing them of liability related to the damage on the car..

I got receipts for every part on the car (over 6K) and I have print outs of several sources (auto trader, ebay, craigslist, forums) 89 s13 coupes for sale, I was going to use this to get them to adjust the actual cash value of the car.. but they wont hear me out...

does this sound legit? at any point would I have to turn over my title? or do a rebuilt title because of them declaring it a total loss? even if I dont turn in the title or sign documents relating to total loss?

your insurance company should be able to inform you, even if they are not handling it, they must know the law/proceedures.

you will not get much adjustment if any for any mods done to the car. Just part it out and be done with it.

I payed 9'000 for an s14 crashed it insurance said only 3,000 total loss they take the car. I said no found a custom car apraiser, he faught insurance that veh is valued over 7,000 according to his research. Cut a deal with insurance for 4,000 and keep s14 and clean title, later sold s14 crashed as is for 4,500. Thats how i had it go down.

When I wrecked my sr s13 we showed insurance all the comparable cars that were for sale as well as getting quotes from shops to do the SR swap. We negotiated the actual value of the car with them.

Since she hit you, another route you can look into is going after her insurance for PROPERTY DAMAGE instead of an accident. That will access the damage for what the parts are worth if you want to fix it. But, it might be too late for this.

I'm pretty sure you can tell them you don't want them to total it. I would agree with talking to your insurance company, or call a lawyer and ask if they have any advice.

my friend just got hit last month by a guy. qtr panel damage and fender damage. quote was 2200 and the total loss was at 2300 so he got 2200 dollars and went rear widebody and got lucky lol.
